NM Dem Prez Caucus: What's Happening Now

Attorneys for the Clinton and Obama campaigns, State Democratic Party officials, various staffers, temporary workers and volunteers are continuing to labor at the accounting firm of RDEW in Albuquerque to produce a final, official tally of the votes cast in New Mexico's February 5th Democratic Presidential Preference Caucus.

Regular paper ballots had been handcounted at the Caucus sites after voting closed on Tuesday. The results were then phoned in to Dem Party headquarters that night, where the tallies were recorded. This constituted the "unofficial count." Next the ballots had to be run through optical scan tabulators, and the results compared with the handcount totals. The signatures of those who signed in to vote at the Caucus sites are being scanned into a computer to produce a master list showing who cast a ballot. There's also a listing of the folks who voted by absentee (mail-in) ballot.

Provisional Ballot Count
Workers are expected to begin sometime today to examine more than 17,276 provisional ballots. The special ballots were used by people who a) showed up to vote but weren't on the registered voter rolls, b) were at the wrong Caucus site or c) had requested an absentee (mail-in) ballot but failed to return it and voted in person instead. The latest update of New Mexico's vote count was released yesterday morning and does not contain any provisional ballots.

Standards for Qualifying Provisional Ballots
Campaign attorneys and Dem Party officials spent the past few days negotiating standards that will be used to judge whether a provisional ballot qualifies as legitimate or must be tossed out. The standards were designed to reject only those provisionals that are obviously illegitimate -- not those that may exhibit minor errors like a missing middle initial. The aim was to be inclusive, transparent, consistent and fair.

Provisional ballot analysis will determine whether the vote was made by a registered Democrat, and whether the individual had voted previously at another Caucus site or via absentee. The Party's registered Democrat voter list has reportedly been rechecked to make sure it contains the names of all the Dems on the Secretary of State's official list. According to Kate Nash, these are the main standards released by the State Party that will govern provisional ballot qualification:

1. The absence of either an inner or outer envelope is not dispositive as to the disqualification of a provisional ballot.

2. The absence of a signature on an affidavit is not dispositive as to the disqualification of a provisional ballot.

3. The absence of the use of the official DPNM affidavit is not dispositive as to the disqualification of a provisional ballot.

4. The absence of the use of the official DPNM provisional ballot is not dispositive as to the disqualification of a provisional ballot.

5. A discrepancy as to the correct congressional district is not dispositive as to the disqualification of a provisional ballot.

6. In accordance with the philosophy of inclusion, if a link can be made between the name of a voter and that voter's provisional ballot, that ballot will be qualified and counted in the tally unless:

a. It cannot be demonstrated within a reasonable degree of certainty that the provisional voter was registered and eligible to participate in the February 5, 2008 caucus;

b. It can be demonstrated within a reasonable degree of certainty that the provisional voter cast another ballot, whether absentee, emergency, regular, or other provisional ballot.

The Party's deadline for certifying the Caucus results is February 15th, and it may take that long to finish the provisional ballot qualification process.

These are exactly the appropriate standards. I congratulate the party and the Obama and Clinton campaigns for doing the right thing. It was inevitable that we would have significant delays counting the provisional ballots. I care only about accuracy, not speed. We'll get this done.

I am thrilled to be a part of our democracy here in NM. I believe we are having THE BEST possible experience of what makes democracy work. Democracy is not a casual drive-through experience, despite the models others may use.

The standards set out above are outstanding. What matters is that every vote and every voter and every volunteer at the polls has been valued. THAT is what counts, and it leads to the most inclusive accounting/counting. The fact that a lot of people are involved and that it is taking time should be lauded.

Hooray for Democracy in NM!!! We LEAD the nation.

This is democracy at work. We should not feel any shame, AND we should be thankful that our party leaders and Maggie Oliver and Robert Adams are taking their jobs as seriously as they are (Maggie and Robert and their staff are working night and day as volunteers.) Nothing AT ALL wrong with what is happening here to make sure that all ballots are counted.

We must, however, demand that our state sever all ties with ES&S. I have been saying this for months, since ES&S dropped those obscene maintenance contracts on the county clerks (which is now being handled by the NM state purchasing dept.) ES&S is bad news, they are partisan, and they have screwed up elections for over ten years now. Flush them, even if it costs the state money.

My sincerest compliments to all the great patriotic people helping to fix the problem. You are all doing great work and I can't say enough for your efforts. I must say that we should not have to be doing this. We moved up our primary/caucus date for the purpose of having an impact on elections which we have not had before. We wanted to be relevant. It was/is our moment to shine and show the other 49 that we matter , that we are ready for prime time. And then this fiasco occurs...again! The following is my letter to the New Mexican. Don't know if they will actually print it in full. I am not the only New Mexican and Patriot who feels this way.

On Friday, February 1st, while freezing in line with 5600 other Patriots, I marveled at the Historical significance of headlights backed up from SFCC to Rodeo Road; and hoped out loud that our polls were ready for an unprecedented turnout. Sadly, my hope was shattered when I realized the most important and sacred core process crucial to preservation of our Constitution was so badly mishandled. The very Soul of our Democracy demands better. You may be willing to accept our Beloved State being measured and judged by the level of your incompetence Brian, but I am not! Congratulations, we are now the laughing stock of the country and you have provided ammunition to Republican arguments that Democrats can’t even administer the selection procedure much less bring positive change to our Nation. There is absolutely no excuse for this voting fiasco. If you are not up to the task then it is imperative we find someone who is; before November. Evidently schmoozing with the "Super Delegates" that hired you is preferable to actually doing the thinking and planning required of your job. Incidentally, why, and by what right are “Super Delegates” political opinions and votes more relevant than ours? They are not, and this UN-Democratic policy of political back scratching and vanity needs to be eliminated along with you. We The People have no time, patience, or room for more "Incompetence as Usual"! We have a current Administration and Congress for that.

The Republicans have been spreading lies and fear for 4 decades now, there's no reason to expect them to ever go low on that kind of ammunition. If it wasn't something like this caucus mess, they'd make up some crap about something even worse...and I'm sure they will anyway. We've all seen good reason to be plenty cynical about a lot of things these last seven years, from Democrats and Republicans alike. I simply don't see this as one of them. I think there's a lot of good that can come out of this. Hell, New Hampshire has been second in line for eternity and they still managed to screw things up - thing is, in New Hampshire, their elected officials are doing everything they can to stymie an honest count. Here, I am thankful to say, we have people who are going to great lengths to preserve your right to have your vote counted. God knows the last thing we need to worry about is what the Republicans are going to say about it.

Instead of writing letters to the editor to use this situation to make political hay - who do you think would better run the party than Brian Colon? - why not roll up your sleeves and get involved. The county parties and state party need help every day, all the time. Get involved. Volunteer. Take on projects, attend party meetings rr volunteer for a candidate you like.

The time for throwing stones from outside the process is over. You have no right to criticize unless you are working to make things better. If you aren't helping and lending your expertise to the party and the candidates and your own government, you are part of the problem not the solution.

Howard Dean always says that if all you do is vote, you get graded a C or a D. Voting is only the beginning if you are a real patriot and take your civic duties seriously. Don't just whine - join up to help.

There is plenty to criticize in any human endeavor. We all make mistakes and misjudgements. Even when the governments of prosperous states undertake elections, there are many problems. Even when the State of New Mexico, with all of its paid, trained and experienced staff run elections, there are problems. This caucus was run almost entirely by volunteers new to the process and giving of their own time and energy. Even given the problems at a HANDFUL of caucus sites, the turnout and processing of huge numbers of voters was very good.

It was rewarding, too, to see people show up to vote and seeing how the turnout was so huge, and some of them stepped right up and volunteered to help out at the site. That's the spirit!

Sorry Quintana, voting in a partisan caucus is not a "sacred core process crucial to preservation of our Constitution..." It is simply a right granted by party rules, an obligation, and a duty of party members.

"There is absolutely no excuse for this voting fiasco." Sure there is. Lack of funds to rent sufficient facilities, to do outreach education, to provide on site supplies, etc. Lack of volunteers. Uninformed voters who didn't know where they were to vote. "Declined to state" voters expecting to play in our party. Record setting turnout.

"If you are not up to the task then it is imperative we find someone who is; before November." Your ignorance is showing. The Democratic Party will have NOTHING to do with the implementation of November election. The state will run it with PAID staff at the familiar local precincts. representatives of the Democratic Party and candidates will act as observers of the slow counting of provisional ballots.

"Evidently schmoozing with the "Super Delegates" that hired you is preferable to actually doing the thinking and planning required of your job." This statement is even more outlandish, childish, and foolish. We the members elected this terrific progressive, and I for one will continue to support his efforts to build this party to be the invigorated modern agent of change and honor. He gets to make massive financial and family sacrifices so he can be unfairly overly-criticized. He stubbed his toe, and in the process made progress.

Thank you, Mr. Streit. FWIW, Brian Colon has been at the REDW accounting firm from 7am to 10pm every day as we finish the voting process. I was there from 5-10pm tonight, and I'm beat.

Institutionalizing bad politics is a wonderful trait of Dems in NM. 2008 is about bringing integrity to our democratic precess. Our party Leadership has failed and the Integrity of this election is in question and anything less than resignation of that leadership Institutionalizes the very corruption and incompetence that the we are fighting against in 2008. Apoligizing for a politicial that fails because you "personally know him" and he "is a really good guy thats at the office all day" are what the insider say in D.C when they search for excuses for a bumbling politicial or beurocrat.

I am suprised that you folks have bought into the mindset of the D.C swamplands.
