From Desi Brown, Aide to Sen. Ortiz y Pino: Please forward to all interested

Here is the latest: The Resolution will be heard for sure tomorrow (Saturday)! As of now (10:30 PM), it is still being heard in the Senate Judiciary Committee at some point in the afternoon (any time after 2:30 PM – could be as late as 9 PM). There is a slight possibility that the resolution will be pulled from Judiciary and put on the floor calendar for the day as well.  If this occurs, then the bill would most likely be the last bill heard during the floor schedule – which could be anywhere from 1:30 PM or later.

Unfortunately, we will not know which will happen until mid-morning at the earliest. If you are planning to come to the hearing, I would suggest calling Senator Ortiz y Pino’s office directly at about 11 AM to see if we have any new news: 505-986-4380.

We hope to have available a 22 minute recording of the live video testimony we conducted today with former congresswoman Elizabeth Holtzman who was on the Judiciary Committee that Impeached Nixon.  It is quite good.  We plan to have a viewing place set up somewhere in the Roundhouse by about 1 PM.  Info will be available in Room 414 (Senator Ortiz y Pino’s Office).

There will be a sign up sheet for speakers available in Room 414 (and outside of the committee room).  Initial indications are that there will be a limited time for citizen input again.

(Updated) URGENT: NM Impeachment Resolution May Go Straight to Senate Floor

UPDATE 1: I just found this hopeful tidbit quoting Senate Majority Leader Michael Sanchez over at Steve Terrell's Legislature Blog:

He believes Senate Joint Resolution 5, which calls for the impeachment of President Bush and Vice President Cheney, will pass the Senate by a party-line vote. Although earlier in the session he said he didn’t back the resolution, he said tonight that he’d probably vote for it. His earlier opposition wasn’t over the merits of the resolution, but because of his questions whether the state Legislature was the proper place for it.

Sanchez said he hopes the Senate Judiciary Committee would pass the resolution out without recommendation to the full Senate, which he said could hear it as early as Saturday. [The resolution would still have to gain passage in the House to be successful.]

Based on reports from Leland Lehrman of Mother Media:
The NM impeachment resolution, SJR 5, may bypass the Senate Judiciary Committee on Friday, March 2nd, and go straight to the Senate Floor. Attorney Randall Cherry -- Senator McSorley's staff analyst -- is the source of this information as directly relayed by citizen Terrence McCarthy of Vivo Studios and corroborated by Jim Williams of KUNM and Dorothy Fadiman of Concentric Media.

Since both the bill sponsor and the Committee Chairman are already in favor, they can make a motion on the floor in open session that the resolution bypass Judiciary. However, this motion must receive unanimous consent -- not likely -- or then win either a voice or roll-call vote. According to Charlotte Roybal, longtime Democratic Party delegate, if the Senate votes to take the resolution out of Judiciary, floor debate on the resolution will still have to wait until Saturday, perhaps around 10AM. Stay tuned via either the sponsors Ortiz y Pino and Grubesic's office, Judiciary Chairman McSorley's office or the Majority Leader Sanchez' office. Again, all can be contacted at 505-986-4300.

Support in the Senate
It's now time to count our votes on the Senate floor. If all the Republicans vote together and are present (likely), we can afford to lose only three Democratic votes against or five abstentions.

Possible negatives: We know that Sen. John Arthur Smith (D-Hidalgo, Luna, Sierra) was solidly against. Tim Jennings (D-Chaves, Eddy, Lincoln, Otero) may take his cue from Smith, but is on the fence, having told me personally: "You can't impeach someone for stupidity." Sen. Lidio Rainaldi (D-Espanola) is known for conservatism, and declined an information packet recently offerred saying that he already knew how he was voting, but not saying how that was. Senator Phil Griego (D-Los Alamos, Mora, Sandoval, San Miguel, Santa Fe, Taos) is also well-known for skepticism.

Unknown: The views of the following Senators are not known and could be swing votes: John Pinto (D-Tohatchi), Lynda Lovejoy (D-Crownpoint), Nancy Rodriguez (D-Santa Fe), Pete Campos (D-Las Vegas), James Taylor (D-Albuquerque), Shannon Robinson (D-Albuquerque).

Who to Call: Given that that the timetable for the floor vote has been accelerated, it is now time for the full-court press. Please contact every Democratic undecided Senator, all the time, especially the swing votes: Sen. Michael Sanchez above all, the rest of the above undecideds and some say Altamirano. Although he voted for the resolution in Rules Committee, Senators do not always vote for a bill on the floor the way they did in Committee, for various reasons. On the Senate Floor: If you're attending the session, please also note decorum without feeling overly restricted. No clapping after speeches or votes in committee or from the gallery, in particular. We won't get a second chance.

The number and type of speakers are being left to the sponsor and Chair this time. The sponsors are now suggesting that we focus on the "asking for an investigation" part and avoid rendering verdicts in our testimony. I agree there may be some merit to the cautious approach at this time. Apparently it may help us with swing voters. Take this under advisement, but it is not meant to stifle your initiative, which is the most precious of all the human qualities found on this team.

Here's the latest on the NM Impeachment resolution, SJR 5, which has so far passed both the NM Senate Rules Committee and the Senate Public Affairs Committee. Next up: Senate Judiciary sometime Saturday, March 3. We need to show up en masse for the hearing and contact Judicary members NOW. This email is from a volunteer aide to Sen. Hello to all! (Please forward to others interested in this issue.) I am sorry I was unable to be present for the exciting success of the Public Affairs Committee Hearing last Sunday. On behalf of Senator Ortiz y Pino and the rest of his volunteer staff, I would like to personally thank all of you who could attend, speak up, or help out in the many ways that you have.

We would like to acknowledge that everyone at these hearings really seems to understand the power of the citizenry to affect change within our government and at the same time, you have all honored the wishes of both Senator Ortiz y Pino and Senator Grubesic to stay focused on the language of the Impeachment Resolution. Just a quick update - there will be more to come later this week:

- SJR5 is tentatively scheduled to be heard in the Senate Judiciary committee late Saturday afternoon this weekend. The committee will start meeting after the Senate floor session is done and there will probably be a few bills heard before this one is. This makes the timing a little bit uncertain for all of you who may wish to attend.

- Right now we cannot say whether the bill will be heard at 3 PM or 8 PM, or any time in between. If you do plan to be present on Saturday just be prepared for a potentially long wait as of now. (Note: You can also call the office of Senator Cisco McSorley for updated time information: 505-986-4485.)

- We hope to be able to narrow down the time frame in the next day or two.

- There will be a taped video conference call from former US Congresswoman Elizabeth Holtzman run during this committee hearing.

- There will probably be a limited amount of public debate again - similar to last time - but the more people packed into the room and in the hallways the better! It really helps to create an air of excitement.

- We will try to have both a pre- and post-committee hearing gathering in the Rotunda to share what information we may have with you.

Keep up with your calls, e-mails, radio show call-ins, letters to the editor (I have only seen a couple so far - keep writing!), personal visits with the Senators and Representatives (and their assistants), and just plain old getting the word out to the general public!

Contact Other Senators Too
Please note that if SJR5 passes through Judiciary, it could hit the Senate Floor fairly quickly, so don't ignore other members of the Senate who haven't heard this in committee yet.

Strategy Note: We are currently trying to reinforce the concept to other Senators that this Resolution is mostly focused on encouraging Congress to open congressional investigations into the improper (yes, illegal) actions that have been taken by our leaders. If these investigations pan out (and how couldn?t they?!), then Congress can pursue the avenue of Impeachment.

- So basically, try to put more of an emphasis on the congressional investigations than the impeachment when dealing with any legislators who may be sitting on the fence regarding SJR5.

They are most likely the swing votes on the committee. Also, Senator Sanchez is the Senate Floor Leader and has much power in determining what gets heard and when on the Senate Floor should this resolution be passed by Judiciary and be awaiting scheduling for a vote by the full Senate. In other words, he can make sure it gets to the floor, or that delays stop it. He also has significant leverage with House members, so he'll be instrumental in the determination of which House committees will hear the resolution IF it passes the Senate.

(Updated) Anne Kass: My Take on the Impeachment Resolution Hearing at Senate Public Affairs

UPDATE: Good news! According to Las Cruces blogger Heath Haussamen, Democratic Sen. Mary Kay Papen (D-Doña Ana 38), was allowed to add her yes vote to the tally on the impeachment resolution since she was present for most of the committee hearing Sunday, making the final Do Pass margin 4-2. Another Democratic member of Public Affairs, Sen. Mary Jane Garcia (D-Doña Ana 36) has signed on to the resolution as a cosponsor even though she wasn't able to attend Sunday's hearing. Hurrah for Senators Papen and Garcia!

A terrific report on today's hearing before the New Mexico Senate Public Affairs Committee on SJR 5, impeachment of Cheney and Bush, from Anne Kass, expanding on my earlier brief post:

The Senate Public Affairs Committee met today to hear Senate Joint Resolution 5--a call to impeach George W. Bush and Dick Cheney.  The Resolution got a "do pass" recommendation from the Committee on a 3 to 2 vote.

A gathering of supporters of the Resolution met at 1:30, where we were joined by a Senate staffer who explained to us that it was generally the view of Legislators that the Committee meeting last week--before Senate Rules--where the 4 Republican Senators were "too busy" to attend, was too "wild."  Someone mentioned the word disrespectful, to which I took offense, as did others.  That hearing was boisterous, passionate and exuberant, but never disrespectful.  In any case, we were cautioned to mind our manners--and we did, or at least I think we did.  Unfortunately, when the Resolution received the 3 to 2 Do Pass recommendation, applause broke out, which may have rendered us, yet again, an unruly bunch in need of yet more manners lectures when this matter comes before Senate Judiciary, hopefully soon.

The Committee meeting began at 2:40. Present were Democrats: the Chair, Dede Feldman, Jerry Ortiz y Pino and, at the beginning Mary Kay Papen (who left after about 45 minutes of public comment and who did not return for the vote).  David Ulibarri came and went, but was there at the end when it counted, and voted "do pass" for the Resolution. Mary Jane Garcia (Las Cruces) for some reason couldn't be bothered to attend any of the hearing. (I wonder how that minding one's manners thing works, exactly.)  Majority Leader Michael Sanchez appeared for part of the hearing, as he did with the Rules Committee Hearing.

The Republicans apparently decided they didn't want any more photos of four empty chairs, so present from that Party were Steven Neville (Aztec), Stuart Ingle (Portales) and Gay Kernan (Hobbs), although Senator Kernan left the meeting just as the Chair was about to call for the vote--hmmmm.  Steve Komadina (Corrales) couldn't be bothered to attend the hearing, as he couldn't be bothered at the Rules Committee Hearing as well.

As with the Rules Committee, the room was packed at least a half hour before the Hearing began and the estimate was that 50 people or more were in the Hall.  I think the Committee Room, which was SRO, holds about 100 citizens.  As with the Rules Committee, more people signed up to speak than there was time to hear.  As with the Rules Committee, the citizens made me proud.

Retired Representative Max Coll appeared to talk in support of the Resolution.  Several teenagers, complete with facial piercings, spoke as compellingly as anyone present--one of them, a young woman, noted that she felt like she was living in a science fiction novel and mentioned that she'd just finished reading 1984 and found current reality more scary than that.  A woman spoke wondering how the absent Senators were going to learn about what the citizens had to say and noted that her son was so upset with the United States that he's become an expatriate.  Several speakers seemed to me to be Republicans, one from the southern part of New Mexico. 

Dallas Timmons said that although she couldn't know for sure what Thomas Jefferson actually had in mind when he wrote the provision that allows a State Legislature to initiate impeachment proceedings, she had a hunch that it was because he knew that State Legislators would be closer to the people than the elected officials in Washington.  She told the Committee they were the last chance we-the-people had and that she hoped they would recognize how sincere and serious we all are and act to send this Resolution to Washington D.C. 

And so they came to the microphone, young, old, middle aged, men, women young people, Democrats, Republicans, one and all expressing their sadness, their outrage, their disappointment, their fear.  It was moving and inspiring, and I'm sorry that any of you reading these words who weren't there missed it.

Chair Feldman asked if there was anyone in the room to talk in opposition.  Not a peep.  She called for comments from the Committee.  Not a peep from the Republicans.  So Chair Feldman thanked Senators Ortiz y Pino and Grubesic and spoke of her own views about the seriousness of the allegations and evidence against Mr. Bush and Mr. Cheney, and then she called for the vote. The two Republicans voted no.  The three Democrats voted yes.  If Senator Gay Kernan had not left the hearing and had voted yes, it would have been tied, which I believe would have been a "no recommendation" which is neutral, as opposed to a "do not pass" recommendation which would have killed the Resolution.

So now it's on to Senate Judiciary, chaired by Cisco McSorley.  We were told that it has been arranged to have a live hook-up with Elizabeth Holtzman, a former Congresswoman who wrote The Impeachment of George Bush, who will testify to the Senate Judiciary Committee.

We need a strong presence at the Senate Judiciary Hearing.  This thing is gathering steam!

SJR 5, the New Mexico impeachment resolution, passed the NM Senate Public Affairs Committee this afternoon by a vote of 3-2! Once again the hearing room was packed, with many left standing and even more trailing out into the hallway. Not one person spoke against the measure during about an hour and 15 minutes of testimony. Particularly moving were a passionate speech from a gentleman from Carrizozo, who led off the testimony, and an eloquent and heartfelt statement by another gentleman who had been a history professor for more than 30 years.

Two Democrats Don't Vote
Although another Dem, Sen. Mary Kay Papen (D-Dona Ana 38), was present for most of the hearing, she left without voting on the measure. The other Dem on the Committee, Sen. Mary Jane Garcia (D-Dona Ana 36), who had previously signed on as a cosponsor of SJR 5, was not in attendance and may have been busy at another committee hearing.

Committee Republicans
Three Repubs attended most of the hearing, although one left near the end and did not vote, thus giving the measure only two nay votes, by Senators Stuart Ingle (R-Chaves, Curry, De Baca & Roosevelt) and Steven Neville (R-San Juan). At the start of the hearing, Ingle also motioned to table the resolution. It failed by a vote of 3-3, with the three Democrats present voting nay and Sen. Gay Kernan (R-Chaves, Curry, Eddy, Lea & Roosevelt) joining Ingle and Neville voting yes.

With a victory previously in the Senate Rules Committee and now this one in Public Affairs, the impeachment resolution moves next to the NM Senate Judiciary Committee. If it passes there, it would go to the full Senate for a vote.

REMINDER: NM Public Affairs Committee Hearing on NM Impeachment Resolution Today, 2PM

A large crowd is needed in Santa Fe today to show there's strong support for SJR 5, requesting that the U.S. Congress initiate impeachment proceedings against Bush and Cheney. Leland Lehrman says the Impeachment support group will meet at 1:30 PM in the Roundhouse rotunda to make plans, including making a suggested speaker list. The Public Affairs Committee, chaired by Albuquerque's Sen. Dede Feldman, has apparently tentatively agreed to hear only 15 witnesses. That may change if there's a strong enough turnout. The Committee may meet as early as 2 PM, but no later than 2:30.

ATTENTION: Next Hearing on NM Impeachment Resolution Set for Sunday

The NM Senate Public Affairs Committee will consider SJR 5, the New Mexico resolution calling for the U.S. Congress to begin impeachment proceedings against Cheney and Bush, in Room 321 at the Santa Fe Roundhouse on Sunday, February 25th at approximately 2:00 PM.

If we want this bill to move forward it's critically important that we have a large turnout of supporters this Sunday, as we did at the bill's first hearing before the Senate Rules Committee. If you possibly can, please come to Santa Fe for the hearing this Sunday. There will also be opportunities for citizen lobbying with legislators and rallying outside with signs before the hearing. Bring your digital camera and I'll be happy to post your photos or videos on the blog.

Whether you can make it on Sunday or not, PLEASE CALL the state senators listed below RIGHT NOW. Be polite, be persuasive and make a personal appeal from your own point of view.

If the resolution passes Public Affairs, it will go next to the Senate Judiaciary Committee. There are several "swing" Democrats on each committee that have not yet shown support for SJR 5. Please contact them and urge them to support the resolution:

One good talking point is to remind Democratic legislators that a very large majority of the 1200 or so delegates to the March 2006 convention of the Democratic Party of New Mexico voted to adopt a platform resolution in favor of impeaching Bush (see front page of Albuquerque Journal above). The resolution is a part of the official platform of our State Party. You can read more about the Party's passage of the impeachment measure in a Daily Kos diary from March 2006.

Another good idea is to call your State Senator and urge them to support the resolution and talk to the Senators listed above to gain their support. To find your Senator, click here. Double Check
Finally, you probably should call the NM Legislature on Sunday morning at 505-986-4300 to make sure there has been no last-minute rescheduling of the hearing on SJR 5. At this point in the process, agendas have a habit of being changed with short notice.

Video: NM Impeachment Press Conference, PLUS How to Help

Thanks to Concentric Media and Mother Media, we now have access to video of the press conference at the Roundhouse in Santa Fe on January 23rd introducing New Mexico's impeachment resolution, SJR 5.
